Typically the O1 visa standard for the Arts is DISTINCTION. What does that mean? Distinction means a high level of achievement in the field of arts evidenced by a degree of skill and recognition substantially above that ordinarily encountered to the extent that a person described as prominent is renowned, leading, or well-known in the field of arts. In general, more than the average person in the field.

But what about Actors in Motion Picture and Television?

For this group there is a higher standard called Extraordinary achievement, meaning a very high level of accomplishment in the motion picture or television industry evidenced by a degree of skill and recognition significantly above that ordinarily encountered to the extent that the person is recognized as outstanding, notable, or leading in the motion picture or television field.

There is a quite a bit of confusion as to what standard must be applied t Actors. It is always important to take into account what the individuals past accomplishments include, but more importantly what are they going to be doing in the future. If the Actor would like to perform in film and television, then they need to be prepared to demonstrate extraordinary achievement, as USCIS will likely apply the higher standard.

As always we recommend consulting with an experienced immigration attorney in the area to provide the necessary guidance in presenting the best case possible.
